The terms and conditions governing your use of the Pact platform.

Introduction

Welcome to Pact. These Terms of Service ("Terms") govern your access to and use of Pact's decentralized service agreement platform, including our website, smart contracts, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

Acceptance of Terms

You must be at least 18 years old to use our Service. By using Pact, you represent and warrant that you:

  • Are of legal age to form a binding contract
  • Have the authority to enter into these Terms
  • Are not prohibited from using the Service under applicable law
  • Will comply with all applicable laws and regulations

Service Description

Pact provides a decentralized platform for creating, managing, and executing service agreements using blockchain technology and smart contracts. Our Service includes:

  • On-chain escrow for secure payment holding
  • AI and human arbitration for dispute resolution
  • Verification and reputation systems
  • Tools for agreement creation and management

User Obligations

When using Pact, you agree to:

  • Provide accurate and truthful information
  • Maintain the security of your wallet and private keys
  • Comply with all applicable laws and regulations
  • Not use the Service for illegal or fraudulent purposes
  • Honor all service agreements you enter into
  • Not attempt to manipulate, exploit, or disrupt the Service

Service Agreements & Escrow

When you create or accept a service agreement on Pact:

  • You enter into a legally binding contract with the other party
  • Funds are held in smart contract escrow until conditions are met
  • You are responsible for accurately defining deliverables and terms
  • Smart contract code determines payment release conditions
  • All transactions are recorded permanently on the blockchain

Pact acts as a technology platform and is not a party to service agreements between users.

Dispute Resolution

If a dispute arises regarding a service agreement:

  • Either party may request arbitration through the platform
  • Arbitration may be conducted by AI or human arbiters
  • Both parties agree to abide by the arbiter's decision
  • Arbitration decisions are final and binding
  • Arbitration fees may apply as specified in the agreement

Fees & Payments

Pact may charge fees for use of the platform, including:

  • Platform fees on completed agreements
  • Arbitration fees for dispute resolution
  • Gas fees for blockchain transactions (paid to network validators)

All fees will be clearly disclosed before you commit to a transaction. You are responsible for all blockchain gas fees associated with your use of the Service.

Intellectual Property

The Pact platform, including its software, design, content, and trademarks, is owned by Pact and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our software or content
  • Reverse engineer or decompile our smart contracts
  • Use our trademarks without permission
  • Create derivative works without authorization

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PACT DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Warranties of merchantability or fitness for a particular purpose
  • Guarantees of uninterrupted or error-free service
  • Warranties regarding the conduct of other users
  • Guarantees of smart contract functionality

You use the Service at your own risk. Pact is not responsible for the actions of other users or the outcome of service agreements.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACT SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from service agreements between users
  • Losses due to smart contract vulnerabilities or blockchain issues
  • Damages exceeding the fees paid to Pact in the past 12 months

Termination

We reserve the right to suspend or terminate your access to the Service if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Pose a security risk to the platform or other users
  • Fail to honor service agreements

Note: Due to the decentralized nature of blockchain, some data and transactions cannot be deleted even if your account is terminated.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective as of" date.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
